Student Reflection on the U.S. Elections COLUMBIA UNIVERSITY - SIPA Admissions Blog We have received some concerned questions from prospective students about last week’s U.S. election results and what a Trump presidency means for students applying to SIPA. As a school of public and international affairs, SIPA has always been a place where students of different backgrounds can come together to peacefully and respectfully discuss their political views and challenge each other to expand their worldviews. We want to reassure everyone that SIPA will continue to encourage students to be open with each other and to advocate for what they believe in while respecting all members of our community. As a current student, it is clear to me that SIPA strives to be a supportive community for all of its students. In the days  since the election there have been several  discussions and forums set up for students to express their reactions to the election results, and a tremendous out pour of support from SIPA faculty and peers. Professors have been available to share their views and reflect on what the election means for the SIPA community, and students have gathered together to strategize for the coming years. The election results may have come as a shock to many, but that hasn’t gotten SIPA students down. This gives us the opportunity to use what we have learned here at SIPA and to unite together. I came to SIPA to advance my career in human rights advocacy, and this election cycle has only strengthened my resolve to achieve that goal. Whether you are upset or happy with the results of the election, and in the wake of political events the world over, it is time for everyone to take a long hard look at what the political system has become and how we can make it better. SIPA is the place for you to do that. The coursework, along with the opportunities to interact with experts in their respective fields and peers from around the world, will give you the knowledge and tools to overcome the challenges our world faces today. It is our responsibility to challenge what we see as unjust and to advocate on the behalf of others that are unable to do so themselves. We’re running through the inky black darkness for what seems like an eternity, we are running out of energy- I’m panting. We slow, eventually stopping, our eyes darting around looking for an exit, nothing. Then we hear the thudding footsteps growing louder so that it sounds echo all around- we are trying to find its origin but we can’t. My friend panics and breaks out in a run yelling for us to follow. One by one we follow running deeper in to the seemingly endless darkness. I would recommend that she use the 12 step program and group therapy as new ways to guide her towards recovery. Since she using these substances in private, I feel she could possibly benefit from others who know and feel the same struggles as she does. This would allow her to not feel alone in her recovery and bring a sense of accountability to prevent from relapse. I would monitor her progress in the 12 step program and encourage her to patiently complete each step. I’m basing my treatment strategy on trust. Marbury V Madison Case and Its Implications The Head of State John Adams, who was a Federalist, lost his bid to Thomas Jefferson, a Republican, after re-elected in 1800. However, Adams and the Federalists still had power for a few months before Jefferson took office. During these months, Adam influenced Congress to pass the Judiciary Act of 1801. The Act enabled Adams to appoint some new federal judges in hope that the Judiciary would be filled with people opposed to the Republican policies and Adams appointed 39 judges. The acting Secretary of State John Marshall had to deliver the official documents for their appointments. John Marshall would later on become the Chief Justice of the Supreme Court and the originator of the Judicial review. However, he failed to deliver the documents to three judges before Adam’s term ended, and in particular, the appointment of William Marbury (Infoplease, 2005). Unfortunately, Jefferson learned of Adam’s schemes and the failure to deliver the remaining documents after assuming office. Jefferson then instructed James Madison, his secretary of state, to decline the appointments. William Marbury went before the Supreme Court to issue an order compelling Madison to authorize his appointment. According to the Judiciary Act of 1789, the Supreme Court had jurisdiction to issue such orders. The major issues underlining this case was whether or not Marbury had the right to the commission and whether the Supreme Court had the authority to review the constitutionality of Acts of Congress. Additionally, the case brought light to the question of whether the Congress could broaden the scope of the Supreme Court’s mandate above those specified in the Constitution (This day in history, 2009). The Court unanimously agreed that Marbury had a right to his appointment and that the Judicial Act was unconstitutional. According to Justice Marshall, the Congress had no mandate to give the Supreme Court powers to issue an order granting Marbury his appointment. Justice Marshall argued that if Acts of Congress conflict with the Constitution, the Acts are not binding in a court of law. Also, the judiciary’s responsibility was to uphold the constitution. However, the constitution did not indicate the Supreme Court having such jurisdiction. Consequently, the Court could not compel Madison and Thomas Jefferson to appoint Marbury (Infoplease, 2005). The Court ruling in Marbury v Madison paved the way for a key precedent, the Judicial Review. Justice Marshall interpreted the Constitution to imply the Supreme Court had powers for judicial reviews. The Supreme Court had the powers to review acts of Congress and the President. Also, the Court could overrule a law they thought was unconstitutional. If laws were in conflict with each other, the Court had the mandate to decide their individual operations. The Constitution indicates that the Supreme Court had original jurisdiction in cases relating to ambassadors and public ministers. However, the Court had appellate jurisdiction in all other cases (This day in history, 2009). Consequently, President Jefferson and the Republicans eliminated the newly appointed judges by revoking the Judiciary Act in 1802. Former Nordstrom employees accuse them of using unfair labor and discriminatory practices to intimidate employees and force them to perform tasks like stocking and picking up merchandise during non-working hours . Nordstrom employees receive little formal training when hired or promoted to new positions, but they are expected to perform their duties consistent with the â€Å"Nordstrom Way† which is customer service above and beyond the call of duty. Training is informally provided through on-the-job communication, which increases the opportunity for miscommunication. This communication can be deliberate due to peer competition and pressures to succeed from managers, or lack of knowledge by co-workers and managers from whom they are encouraged to seek training. Management skills are not required to manage employees, nor is training provided to employees who achieve management positions. There is no real evaluation system in place to measure employee performance. There is no goal setting process that requires â€Å"manager – employee pair sets benchmarks for measuring progress, particularly when the employee is new in the role† (Harvard Business School Press, 2007). Goals help to define what managers expect from their employees. The only employee metric used that is measurable is Sales per Hours (SPH) even-though there are other performance criteria such as customer service and teamwork which are part of the employee evaluation process. Employees who do not achieve the minimum required SPH are categorized as under-performers. If SPH is consistently below the minimum standard set by the department manager, this can lead to termination or isolation as employees feel uncomfortable and inadequate. Upon being hired by Nordstrom employees are told that â€Å"the three Nordstrom performance criteria: customer service, productivity and teamwork† (Buller, Paul F. and Schuler, Randall S. , 2003) are needed to be promoted. However employees are not advised as to how the criteria will be evaluated. The only evaluation employees receive is from their manager, there is no secondary layer of management to review the employee performance evaluation to ensure fairness. Nordstrom does not have a formal company-wide evaluation form, therefore there is no consistency in the evaluation process. The evaluation technique is different for each manager, making it difficult to compare employee performance across the different functional areas in the company. Employees performing tasks not directly related to merchandise sale, are not compensated for hours worked. Observational learning was used to encourage employees to work non-selling hours off the clock â€Å"If one employee is donating a lot of time it forces others to do the same† (Buller, Paul F. and Schuler, Randall S. , 2003). Employees are forced to adhere to the informal organizational culture or they are not considered team players. Nordstrom should establish formal and consistent Standard Operating Procedures, to which their employees can resort to for guidance. Managers should be required to attend training programs. This would enable managers to provide their employees with formal training base on the company’s policies and procedures. Formal training along with on-the-job training would help to alleviate some of the obstacles faced by current or new employees who are promoted to new positions within the organization. Employees should be provided with handbooks and/or training materials that specifically outlines how performance criteria will be measured and evaluated. Managers and employees need to establish goals and ways to achieving them. They should meet on an on-going basis to discuss employee progress for each performance criteria. Nordstrom has used their decentralized management approach to build a very successful and profitable retail empire. They encourage entrepreneurial opportunities among their employees. New employees are given business cards and encouraged to build relationships with their customers, by creating personal â€Å"thank you† letters, and keeping records of merchandise they sell. They are also encouraged to develop a solid customer base. Nordstrom allow employees to be involved in the decision making process, by not restricting them with lots of rules, for instance â€Å"Nordstrom replaced its 20-page rule book with a one-page sheet and few words of wisdom: â€Å"Use your best judgment in all situations† (Buller, Paul F. nd Schuler, Randall S. , 2003). This allows employees to do whatever it takes to ensure their customers are satisfied. Self-motivation courses are offered to both employees and managers with emphasis on setting daily accomplishments. Employees are allowed to set their own personal goals and the pace at which they achieve those goals. For example one employee stated â€Å"the first year I consciously set quarterly goals to achieve the Pacesetter requirement†¦Ã¢â‚¬ ¦and closely monitored my progress† (Buller, Paul F. and Schuler, Randall S. 2003). Employees are given the flexibility to essentially manage themselves and track their own progress with one objective: keep sales per hour high relative to hours worked. Employees are duly compensated for their hard work and dedication â€Å"Nordstrom employees earn some of the highest salaries in the retail business† (Buller, Paul F. and Schuler, Randall S. , 2003). They also encourage hard work by promoting from within which motivates employees to work hard as a promotion could lead to a higher salary and other incentives. Nordstrom uses positive reinforcements by providing various incentives to employees to encourage them to achieve high SPH, for example free dinners, cash rewards and store discounts. Employees who achieve the highest sales are recognized by having their picture displayed in the store and also having their names broadcast over the store’s loudspeaker system. Employees can track how they are performing in relation to their peers on a regular basis, as SPH figures are displayed for all to see via charts and electronic printouts. The problem arose because Nordstrom did not have any formal company policies which are necessary in order to establish required behavior from individual employees. Employee expectations were not explicitly communicated and expectations were established by managers without employee involvement. Managers did not take the time to â€Å"find out what employees think of the proposed expectations† (Harvard Business School Press, 2007). Their only focus was ensuring that Sales per Hour (SPH) remained high, employee development was not important to managers. Nordstrom’s hiring policy requires employees to be innate â€Å"Nordies. † Nordies are â€Å"nice, motivated, hardworking†¦.. self-empowered people who have an entrepreneurial spirit† (Buller, Paul F. and Schuler, Randall S. , 2003). Employees and managers never collaborate to set individual goals, instead goals were set by departmental managers or store managers, but employees are still expected to achieve goals. Outstanding performance was expected from all employees even-though goals were not individually tailored. Employees who â€Å"regularly had trouble meeting sales quotas or coping with pressure to improve performance were dismissed† (Buller, Paul F. and Schuler, Randall S. , 2003). Steep negative consequences were suffered by employees that did not perform up to par with their peers. Setting individual employee goals and ways to achieve them will yield the most desired result in the long term. By providing formal training to employees, and explicitly stating what is expected from the employee, will result in more productivity from employees in the long run and reduce the company’s turn-over rate. This will also reduce the cost for hiring new employees, as replacing employees cost one and a half times the current employee salary to hire a new employee, therefore saving Nordstrom money in the long term. On-going review of employee progress will help to level the playing field and relieve some of the pressures and intimidation some employees feel working at Nordstrom. Formal training of employees is both costly and time consuming. The time spent training employees lowers SPH as this time would be considered non-selling hours. Employees who are successful under the current system might resist changes. Employees might not have the educational capacity to learn new techniques. Employee training is the best option, and will yield the most desired long term results. Develop and roll out a company-wide Standard Operating Procedure handbook using input from outside sources in order to achieve desired results. Develop a company-wide evaluation form enabling standardization of the way employees are evaluated by managers. It was seen as a eugenic success because of a sudden increase in population and frenzy to control this. I understand that eugenics may be intended to promote reproduction among the genetically advantaged. Therefore, in that sense I find it to be acceptable to some extent. The practices that follow this type of positive eugenics, nowadays, is slowly being accepted in society. Such as, in vitro fertilization, a couple may find this option as a gift in life. However, others may argue that adoption is always the best option when infertility is an issue. The fact that there are millions of children that do not have parents, would make me opt for child adoption. As previously mentioned, birth control is considered a eugenic success. In this area I would agree with that generalization. I find that women should take care of themselves form of eugenics that I consider eugenics negative when the attempt is to subordinate fertility amongst the genetically underprivileged. From the beginning of the play to the end, Oedipus is determined to figure out who killed Laios. He is consistent and will not stop until he finds the truth. Iokaste tells Oedipus to stop looking for the truth, but Oedipus will not listen. He tells Iokaste, â€Å"I will not listen; the truth must be made/known† (3. 145). The last quality that plays a part in Oedipus’ downfall is his realistic outlook. At the end of the play, Oedipus is realistic when he discovers the truth. â€Å"And now what is left? /Images? Love? A greeting even, / Sweet to the senses? Is there anything? /An, no friends: lead me away. /Lead me away from Thebes† (Exodos.171-121). He is very realistic in knowing that there is nothing left for him in Thebes. Furthermore, Oedipus realistically accepts his fate and lets Kreon become ruler. â€Å"No, For the love of God, conceal me/Somewhere far from Thebes; or kill me; or hurl me/Into the sea, away from men’s eyes for ever† (Exodos.182-184). Oedipus knows what he did is wrong and knows that he deserves to be exiled. He is realistic in his punishment. La pensià ³n de alimenticia o manutencià ³n, conocida en inglà ©s como child support, es la cantidad de dinero que un padre o una madre que no vive con sus hijos debe pagar al progenitor que sà ­ convive con ellos para su mantenimiento. En el caso de que los padres no està ©n ni hayan estado casados, la paternidad deber probarse o reconocerse  primero.  ¿Cà ³mo se calcula cantidad a pagar por child support? La cantidad que se debe pagar depende de diversas circunstancias, como las necesidades del menor, costo del seguro mà ©dico, los ingresos de cada uno de los padres, la existencia de ms hermanos u otras obligaciones familiares, el tiempo que el menor pasa con cada uno de los padres, etc. Puede haber un acuerdo entre los padres o, a falta del mismo, seguir las reglas de cà ³mputo del estado en el que reside el menor. Cada uno de los 50 estados de los Estados Unidos tiene distintas reglas. Si se desea obtener una idea de la cantidad que podrà ­a corresponder a un nià ±o se puede utilizar una calculadora online (en inglà ©s). Es necesario elegir la del estado que corresponde. Hay que destacar que, como regla general, se tiene en cuenta el salario bruto de los padres, es decir, incluidos los impuestos que le retienen o paga. En el caso de los migrantes indocumentados que por su estatus migratorio puede que no puedan probar cunto ganan la cantidad se estima segà ºn su ingreso potencial, lo que se conoce en inglà ©s como potential income. Esto tambià ©n puede pasar con otros padres sin que importe su estatus migratorio y se dà © la circunstancia de que trabajan a tiempo parcial, ya que se puede considerar que podrà ­an trabajar ms. Por otro lado, dependiendo de los estados, si uno de los padres recibe ayuda del estado podrà ­a considerarse que sus ingresos equivalen a 0. Adems, hay que tener en cuenta que no se tienen en cuenta los gastos mensuales de cada uno de los padres. Segà ºn los à ºltimos datos proporcionados por la oficina del Censo de los Estados Unidos, la cantidad media que se recibe en concepto de child support por nià ±o por mes es de $329. Como regla general la cantidad a pagar se fija en el mismo momento en que se establecen los derechos de visita del progenitor que no vive con el infante o adolescente. Posteriormente puede solicitarse una revisià ³n de la cantidad si hay un cambio en los ingresos por parte de la persona que debe pagar, tanto si se incrementan como si disminuyen.  ¿Cà ³mo se obliga a un padre o madre a pagar por child support? En principio, deberà ­a haber un acuerdo voluntario entre ambos padres. En la actualidad apenas un 10 por ciento de todos los acuerdos de child support se hacen de ese modo.  Si no hay acuerdo voluntario entonces el padre o la madre que convive con el menor puede: contratar a un abogado privadamente para que resuelva el casopresentarse en corte y directamente demandaracudir a la oficina del fiscal del estado en la agencia de Child Support y solicitar ayuda. En los casos en los que el progenitor que vive con el menor recibe beneficios sociales como Medicaid o TANF se puede recibir ayuda legal gratuita para este tipo de casos. Las multas son el origen de deudas finales altas cuando lo que se debà ­a inicialmente por impago del child support era mucho ms bajo.Pena de prisià ³n. Tiene que ser decretada por una corte y generalmente se da en situaciones de desacato a la corte (contempt) o se trata de una persona que ha incumplido en ms de una ocasià ³n. Son muy raras las penas de prisià ³n superiores a seis meses.Expulsià ³n del Ejà ©rcito, en el caso de militares.  Notificacià ³n a los credit  bureau, lo cual puede afectar  negativamente al  crà ©dito. Suspensià ³n de la licencia de manejar.Anulacià ³n del pasaporte estadounidense o no entrega de uno que se solicita  siempre y cuando la deuda por impago sea igual o  o superior a $2,500.  Efectos migratorios para obtencià ³n de beneficiosPena de crcel para los padres que se mudan a otro estado En este à ºltimo caso, el padre o la madre que incumple con su obligacià ³n de pagar el child support se muda de estado con la intencià ³n de que sea ms difà ­cil hacerle cumplir puede ser condenado por un delito federal, en aplicacià ³n de la ley que se conoce como Deadbeat Parents Punishment Act. Esta ley prevà © penas de crcel para los padres que se mudan a otro estado y dejan de pagar por ms de un aà ±o y deben ms de $5,000 o no han pagado por ms de dos aà ±os y el monto supera los $10,000. Si se trata de una primera ofensa, la pena de prisià ³n puede ser acordada hasta un mximo de seis meses. Para los que es su segunda ofensa, la pena de prisià ³n puede alcanzar los dos aà ±os. Adems, se sigue teniendo la obligacià ³n de pagar los atrasos. Consecuencias migratorias si no pagan el child support El no pagar la pensià ³n de alimentos a los hijos puede tener distintos efectos migratorios. Por ejemplo: Los residentes permanentes que desean convertirse en ciudadanos americanos por medio del proceso de naturalizacià ³n pueden ver que su peticià ³n es rechazada. Asimismo, el no pagar la pensià ³n de alimentos puede tener consecuencias graves en todos aquellos casos en los que es necesario acreditar buen carcter y/o la ley concede discrecià ³n para conceder un beneficio migratorio a un oficial o a un juez de inmigracià ³n. Como ejemplo de casos migratorios en esta categorà ­a destacan: El ajuste de estatus  para adquirir la tarjeta de residencia permanente.La cancelacià ³n de la deportacià ³n.Y la salida voluntaria.La obtencià ³n de la green card por el registry.Por à ºltimo, no olvidar que los casos de no pago de la pensià ³n de alimentos puede acabar en casos extremos en un arresto. Por ejemplo, en el caso de  indocumentados, puede significar posiblemente su deportacià ³n. Por otro lado, cobrar child support no se considera welfare ni carga pà ºblica y no afecta a la hora de recibir un beneficio migratorio.  ¿Quà © hacer cuando no se puede pagar child support? Todos los padres y madres tienen la obligacià ³n de contribuir al mantenimiento de sus hijos. Sin embargo, en ocasiones es muy difà ­cil hacer frente a esta obligacià ³n econà ³mica. Por ejemplo, en los casos de despido o de enfermedad. Pero teniendo en cuenta las consecuencias serias del impago nunca se debe dejar de pagar sin ms. Adems de notificar al otro progenitor sobre la incapacidad temporal para pagar es recomendable hacerlo saber tambià ©n a la agencia estatal o local que se ocupa de estos asuntos (en la mitad de este artà ­culo aparece un enlace para busca el que corresponda al estado en el que se debe pagar). Y ahà ­Ã‚  pedir que se le revoque la visa y que no pueda entrar a Estados Unidos. Tambià ©n puede darse un caso distinto. Si el menor est en Estados Unidos y el padre o la madre que no paga est en el extranjero, se puede obligarle a pagar en corte. Y es que Estados Unidos tiene un acuerdo con 77 paà ­ses para hacer posible que los nià ±os reciban de sus padres y madres la pensià ³n de alimentos. Casos especiales: infante fuera de Estados Unidos y progenitor en este paà ­s Hay casos en el que los nià ±os estn en el extranjero y su progenitor en Estados Unidos y à ©ste no cumple con la obligacià ³n establecida legalmente de pasarle una pensià ³n de alimentos. En estos casos se puede recurrir a un abogado estadounidense para que haga valer en corte esa obligacià ³n. Adems, si el paà ­s en el que vive el nià ±o tiene acuerdos con los estados de USA en el que vive el padre (o la madre) que no paga pensià ³n alimenticia, se puede solicitar que cumpla con su obligacià ³n con la ayuda de ese gobierno. Por ejemplo, en el caso de Mà ©xico se puede reclamar con bastante à ©xito cuando el nià ±o es mexicano, se encuentra allà ­ y el pap est en uno de los estados con los que hay un acuerdo de este tipo. Incluso en los casos en los que el padre o la madre obligado al pago sea un inmigrante indocumentado. Tambià ©n puede darse un caso distinto. Si el menor est en Estados Unidos y el padre o la madre que no paga est en el extranjero, se puede obligarle a pagar en corte.
